Engage Search Limited Privacy Notice

This Privacy Notice explains in detail the types of personal data we may collect about you when you interact with us. It also explains how we’ll store and handle that data and how we keep it safe.

The purpose of this note is to ensure as best we can that you are fully informed about your rights, and how the Engage Search Limited uses your data. Should you have questions about the below, please do get in touch with us.

What is Engage Search Limited (ESL) and what is our core business?

 

  • ESL is an executive search consultancy that specialises in the financial markets sector.

  • Our core area of focus is on the talent/candidate identification, tracking and selection for major financial institutions globally who are looking to formulate and execute hiring within their businesses. The majority of our clients are major investment banks, but our client base is not limited to this area.

  • Our fees are paid by our clients for the selection and successful employment of candidates.

 

What data is being collected?

 

  • We collect the information necessary to be able to find available opportunities, as well as further information needed to assess your eligibility through the different stages of recruitment. This information includes CV’s, identification documents, educational records, work history, employment and references.

  • We may also collect sensitive personal data about you, in the form of compensation history, performance history, nationality and working visa eligibility and contact details. We only collect sensitive personal data from you, and further process this data, where you have given your explicit consent.

Complaints

 

  • There are a range of sources from which information will be collected/received.

  • Directly from you:

    • This is information you provide while searching for a new opportunity and/or during the different recruitment stages.

    • During our ongoing, long-term interaction/conversation with you as a market participant. Tracking of your career, your aspirations and achievements.

  • From an agent/third party acting on your behalf. e.g. Interim Management Company.

  • Through publicly available sources. We use the following public sources, for example, LinkedIn.

  • By reference or word of mouth. For example, you may be recommended by a friend, a former employer, a former colleague or even a present employer.

    • The GDPR allows a range of different bases under which a company can collect and process data. At all times, our focus will be on maintaining the highest possible standards and adapting the basis under which we use the data according to our relationship with you, previous interaction and the type of data we are processing.

    • For ESL, we have identified two that apply to the company and our activities:

      • Legitimate Interest: When we require your data to pursue our legitimate interests in a way which might reasonably be expected as part of running our business and which does not materially impact on your rights, freedoms or interests.

      • Consent: When we enter into a process that requires the use of more sensitive data (for example, your CV) we will ask for explicit consent to use that data after making it clear who we will share it with and/or under what circumstances we will share it.

    • Your information will be used by us to identify and inform you of potentially suitable employment opportunities that arise over time.

    • In order to do this, we may need to intermittently contact you to review your current role/mandate/focus, as well as career aspirations. All this is to ensure you are kept informed of the most relevant opportunities.

    • We will sometimes discuss general information about the roles that individuals carry out within your firm in order to keep our clients updated as to the broad candidate landscape, but will always gain consent if your rights or freedoms could be materially impacted. We use your personal data to match your skills, experience and education with a potential employer. We will initially collect basic information on you such as contact details, job role and experience and then pass this on to the client in search of personnel.

    • We will store the data for as long as is necessary for the purposes for which it was collected. Given the ongoing nature of the business we undertake, keeping up to date on an individual’s career is a long term commitment.

    • At the end of the retention period, your data will be deleted completely.

    • Data may be shared with third parties, but this will only be via explicit consent or under the basis of legitimate interest. The data will only be shared under legitimate interest if your rights or freedoms won’t be materially impacted. The data will be shared with clients (major financial institutions) with whom we have a contractual relationship and brings with it safeguards that it will be used in a responsible manner.

    • Access to the personal data we hold about you, free of charge in most cases.

    • The correction of your personal data when incorrect, out of date or incomplete.

    • For example, when you withdraw consent, or object and we have no legitimate overriding interest, or once the purpose for which we hold the data has come to an end (such as the end of a warranty).

    • That we stop using your personal data for direct marketing (either through specific channels, or all channels).

    • That we stop any consent-based processing of your personal data after you withdraw that consent.

    • Review by a Partner of any decision made based solely on automatic processing of your data (i.e. where no human has yet reviewed the outcome and criteria for the decision).

    • You have the right to request a copy of any information about you that ESL holds at any time, and also to have that information corrected if it is inaccurate.     • Your right to withdraw consent: Whenever you have given us your consent to use your personal data, you have the right to change your mind at any time and withdraw that consent.

    • Where we rely on our legitimate interest: In cases where we are processing your personal data on the basis of our legitimate interest, you can ask us to stop for reasons connected to your individual situation. We must then do so unless we believe we have a legitimate overriding reason to continue processing your personal data.

    • Direct marketing: You have the right to stop the use of your personal data for direct marketing activity through all channels, or selected channels. We must always comply with your request.

    • Checking your identity: To protect the confidentiality of your information, we will ask you to verify your identity before proceeding with any request you make under this Privacy Notice. If you have authorised a third party to submit a request on your behalf, we will ask them to prove they have your permission to act.

    • We may contact you by phone, email or social media. If you prefer a particular contact means over another please just let us know.

    • If you feel that your data has not been handled correctly, or you are unhappy with our response to any requests you have made to us regarding the use of your personal data, you have the right to lodge a complaint with the Information Commissioner’s Office.
